General Terms and Conditions (GTC) of Pfälzischer Rennverein Haßloch e.V.

1. Scope of Application

These General Terms and Conditions, as valid at the time of the order ('GTC'), apply to all contracts, orders and enquiries relating to the brokerage of tickets between you ('you' or 'customer') and Pfälzischer Rennverein Haßloch e.V. ('Pfälzischer Rennverein Haßloch e.V.'). Deviating contractual terms and conditions of the customer shall not be recognised unless Pfälzischer Rennverein Haßloch e.V. expressly agrees to their validity in writing. 2. Contracting Parties

Pfälzischer Rennverein Haßloch e.V. acts as a commercial broker for tickets for leisure events organised by third parties ('organiser'), in the name and on behalf of the respective organiser. Pfälzischer Rennverein Haßloch e.V. is not an organiser and does not itself offer any events, unless expressly stated otherwise.

(d) the commercial or business sale or use of tickets, or allowing tickets to be used, without the express authorisation of the organiser, in particular also for the purposes of advertising, marketing, as a bonus, as a promotional gift, as a prize or as part of an unauthorised hospitality or travel package;

(e) the resale of tickets (even for private purposes) at a price higher than the original price paid at the time of ordering;

(f) the transfer of tickets to commercial or business resellers and/or ticket dealers;

(g) regular transfer and/or transfer in larger quantities, whether on one event day or spread across several event days;

(h) the resale or transfer of tickets purchased using automated processes designed to circumvent restrictions on the number of tickets that can be purchased by one person or other regulations applicable to the sale of tickets (so-called BOT purchases).

8.4 Permissible private transfer: The transfer of tickets to third parties in a private context, via a secondary market platform authorised by the organiser or at cost price is permissible, provided there is no breach of clause 8.3 and the customer incorporates these GTC as well as the house rules of the event venue into the contract with the third party, so that both apply in full also in the relationship between the third party and the organiser. (c) exclude affected customers from purchasing tickets for an appropriate period of time;

(d) not deliver and to cancel against reimbursement of the price paid other tickets already purchased by the affected customer, including for comparable events;

(e) in the event of inadmissible transfer of tickets pursuant to clause 8.3 (c) and/or 8.3 (e), to demand payment of the additional proceeds or profit achieved from the respective customer.
